Sponsor compliance duties

Sponsor compliance starts before approval.

The Home Office expects licensed sponsors to keep records, monitor sponsored workers, report relevant changes and maintain audit-ready HR systems.

Record keeping

Worker files, contracts, RTW evidence and contact details retained per Home Office rules.

Right to work checks

Manual, online and IDVT checks completed correctly before employment starts.

Worker monitoring

Attendance, absences and duties matched to the assigned CoS.

Reporting duties

Changes to role, pay, address or sponsor circumstances reported via SMS in time.

HR system readiness

HRIS configured to evidence checks, dates and document expiry alerts.

Key personnel

Authorising Officer, Key Contact and Level 1 User assigned and trained.

Renewal planning

Licence-expiry calendar, evidence refresh and renewal application timed in advance.

Audit preparation

Files, RTW evidence and HR processes maintained in an audit-ready state at all times.

Home Office audit readinessPrepare for Home Office audit

Audit readiness is a habit — not a last-minute project.

Home Office compliance visits can be announced or unannounced. Sponsors who maintain evidence, records and HR processes throughout the licence cycle handle visits calmly.

  • RTW evidence retained and dated correctly for every sponsored worker.
  • SMS reports filed for material changes within reporting windows.
  • Sponsored role, salary and duties match the CoS originally assigned.
  • Key personnel trained on duties, with deputies named where required.
Licence suspension & revocation

Suspended or at risk of revocation? Move quickly and carefully.

Time-sensitive responses with structured evidence and clear representations make the difference. We support sponsors throughout — not after the fact.

  • Review the suspension notice and the underlying compliance concerns.
  • Gather documentary evidence to address each cited concern.
  • Prepare a structured written response within the required timeline.
  • Implement remediation steps to strengthen the wider compliance posture.

Frequently asked

Sponsor licence and immigration questions.

Most sponsor licence applications are decided within eight weeks. A priority service is sometimes available for an additional fee, and the Home Office may request a compliance visit before deciding.

There is no prescribed system, but you must be able to evidence right to work checks, monitor attendance and duties, retain contracts and identity records, and report material changes through SMS. We review whatever HR stack you have today and document what needs to be added.

No — and any adviser claiming otherwise should be treated with caution. Final decisions remain with the Home Office. Our work is to prepare the strongest possible application and to keep your business compliance-ready throughout.

Suspension pauses your ability to assign new Certificates of Sponsorship while the Home Office investigates compliance concerns. Existing sponsored workers are not automatically affected. The response is time-sensitive and should be structured around the specific concerns raised in the notice.

Harveys Legal is a regulated immigration practice operating to legal-services standards. We support sponsor licences, ongoing compliance, Home Office audits and defence work — not single visa form-filling. We do not offer guaranteed approvals, fast-tracks or marketing-led visa products.

From the founder

Most UK employers don't need a visa agency. They need someone who reads the rules, looks at how the business actually works, and tells them the truth.

Especially when the truth is “wait, fix this first.”That's why I built Harveys Legal.
